6. The employment contract
It is important to remember that in all dealings with an employee and especially in regard to disciplinary procedures and dismissals, the employer must comply with the terms in the employment contract between the parties. If the contract does not have disciplinary or termination clauses, then the Employment Relations Act (2000) applies. The Act is clear. These notes provide the guidelines to follow.
